By visiting the site, browsing any page or placing an order, you are using our "Service" and agree to be bound by these Terms of Service ("Terms"), together with the policies referenced in them: our Shipping Policy, Return and Refund Policy and Privacy Policy. Please read them carefully before using the site. If you do not accept these Terms, please do not use the site.

These Terms are written for consumers buying for personal use. Nothing in them removes or limits your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Where anything in these Terms conflicts with those rights, your statutory rights apply.

Our store is hosted by Shopify, which provides the e-commerce platform we use to sell to you.

Section 1 - Online store terms

By agreeing to these Terms you confirm that you are at least 18 years old. Our products, in particular those containing lithium batteries, are not toys and are not intended for purchase or unsupervised use by children.

You may not use our products, services or site for any unlawful or unauthorised purpose, and you must comply with all applicable laws, including intellectual property laws. You must not transmit any viruses or other harmful code. A breach of these Terms may result in immediate termination of your access to the Service.

Section 2 - General conditions

We reserve the right to refuse service to anyone, at any time, for any reason permitted by law.

You understand that your content (not including payment card details) may be transferred unencrypted and may involve transmissions over various networks and changes to conform to the technical requirements of connecting networks or devices. Payment card details are always encrypted during transmission.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service, or access to it, without our express written permission.

Headings are for convenience only and do not limit or otherwise affect these Terms.

Section 3 - Accuracy, completeness and timeliness of information

We work to keep the information on this site accurate and current, but we cannot promise that all content is complete, error-free or up to date. General content on the site is provided for information only.

Preparedness information is general information, not emergency advice. Our product pages, guides and emails describe what our products do and how they may help in a power cut or similar situation. They are not professional, medical, safety or emergency advice, and they do not replace official guidance. In an emergency, call 999. For a power cut, call 105. Official guidance on preparing for emergencies is published by the UK Government and the relevant emergency services.

The 72 Hour Kit is an independent retailer. We are not affiliated with, endorsed by or acting on behalf of the UK Government, the Met Office, the NHS or any emergency service.

Section 4 - Changes to the Service and prices

Prices and availability of products may change at any time without notice. Changes do not affect orders we have already accepted.

We may modify, suspend or discontinue the Service (or any part of it) at any time without notice. We are not liable to you or any third party for any price change, modification, suspension or discontinuance of the Service.

Section 5 - Products

Our products are available online only and some may be available in limited quantities. We make reasonable efforts to display product images, colours and specifications accurately, but we cannot guarantee that your screen will show colours exactly. Minor variations in packaging or in the exact model supplied may occur where the specification is equivalent.

Kits. Each kit page lists every item it contains. Our kits are non-food: they do not contain food, water or medicines. You add water, the food you already eat and any medicines you need, and we explain on each kit page how much we suggest. It is your responsibility to add, store and periodically check these items.

Safety and instructions. Always read and follow the instructions supplied with each product. Products containing lithium batteries (such as power banks, radios and torches) come with safety notes: keep them away from heat, water and physical damage, use only the supplied or recommended charging cables, and do not leave them charging unattended. Our products are not toys and must be kept out of the reach of children. We are not responsible for loss or damage caused by misuse or by failure to follow the supplied instructions.

We reserve the right to limit the sale of our products to any person, region or jurisdiction, and to limit quantities per person, per household or per order. We may discontinue any product at any time. Any offer made on the site is void where prohibited.

Section 6 - Orders and the contract

When you place an order you are making an offer to buy. We send an order confirmation email to acknowledge it, but the contract for an item is formed only when that item is dispatched. We may refuse or cancel any order before dispatch, for example because of a pricing or stock error, a suspected fraudulent order, or because the order appears to be placed by a reseller. If we cancel an order you have paid for, we will refund you in full.

Because kits are made up of items from different suppliers, one order may be dispatched as several parcels on different days, as described in our Shipping Policy.

You agree to provide accurate, current and complete purchase and contact information so that we can complete your transaction and contact you if needed.

Section 7 - Prices, payment and billing

All prices are shown in pounds sterling (GBP) and include UK VAT where applicable. The delivery cost, if any, is shown at checkout before you pay. The total shown at checkout is the amount you will be charged.

Payment is taken in full in GBP when you place your order. Payments are processed by Shopify Payments, using the payment methods shown at checkout. We do not store your full card details; payment data is handled by the payment provider under its own terms and privacy policy.

If a payment is declined, interrupted or otherwise unsuccessful, the order will not be processed until payment is completed. If a product's price is obviously wrong, we may cancel the order and refund you rather than supply the product at the wrong price.

If you have a problem with a payment or an order, please contact us first at info@the72hourkit.com so we can resolve it. Chargebacks raised without contacting us, or that appear to be unjustified, may be disputed with the card provider.

To protect customers and the store, we may hold or cancel an order that appears suspicious, and we may ask for additional verification before processing certain orders.

Section 8 - Delivery

We deliver to addresses in the United Kingdom only. Dispatch origins and estimated delivery times are shown on each product page and in our Shipping Policy. Delivery times are estimates and may be affected by weather, strikes, customs checks or other events outside our control. The goods become your responsibility once they have been delivered to the address you gave us.

Section 9 - Cancellation, returns and refunds

As a consumer you have the right to cancel your order for any reason within 14 days of receiving the goods, and then 14 days to return them. Goods must be unused and in their original packaging; used hygiene items cannot be returned unless faulty. If goods are faulty or not as described, you have the remedies set out in the Consumer Rights Act 2015, including the right to reject within 30 days for a full refund, and the return is free. Full details, including how to arrange a return, are in our Return and Refund Policy. Refunds are made to the original payment method.

Section 10 - Optional tools and third-party links

We may give you access to third-party tools which we neither monitor nor control. These are provided "as is" and "as available", without warranties, and your use of them is at your own risk.

Links on our site may take you to third-party websites, including official government guidance pages, that are not affiliated with us. We are not responsible for examining or evaluating their content or accuracy and we have no liability for third-party materials, websites, products or services. Please review their policies before you interact with them.

Section 11 - Comments, feedback and suggestions

If you send us comments, ideas or suggestions, including product suggestions, you agree that we may use them without restriction and without any obligation to keep them confidential, pay for them or respond to them. We may, but are not obliged to, remove content that we consider unlawful, offensive or in breach of these Terms or any third party's rights.

You agree that your submissions will not infringe any third-party right, contain unlawful or abusive material or malicious code, or misrepresent who you are. You are solely responsible for what you submit.

Section 12 - Personal information

Your submission of personal information through the store is governed by our Privacy Policy.

Section 13 - Errors, inaccuracies and omissions

Occasionally the site may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, delivery charges, delivery times or availability. We reserve the right to correct them and to update information or cancel orders affected by them, including after an order has been submitted, in which case we will refund any payment taken.

Section 14 - Prohibited uses

You may not use the site or its content for any unlawful purpose; to solicit others to perform unlawful acts; to violate any laws or regulations; to infringe our or others' intellectual property rights; to harass, abuse or discriminate; to submit false or misleading information; to upload or transmit malicious code; to collect the personal information of others; to spam, phish, scrape or crawl; or to interfere with the security or operation of the Service. We may terminate your use of the Service for breaching any of these.

Section 15 - Disclaimer of warranties; limitation of liability

We do not guarantee that your use of the Service will be uninterrupted, timely, secure or error-free, and we may remove the Service for indefinite periods or cancel it at any time without notice.

Except for the statutory rights and guarantees that apply to consumers, which are not affected, the Service is provided "as is" and "as available" without warranties of any kind.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights as a consumer, or for any other liability that cannot be excluded by law.

Subject to that, we are not liable for any loss that was not a foreseeable result of our breach of these Terms, for business losses, or for loss or damage caused by misuse of a product or failure to follow its instructions. Our products are intended to help in a power cut or similar disruption; they are not a substitute for the emergency services or for official guidance, and we are not liable for the outcome of any emergency.

Section 16 - Indemnification

You agree to indemnify and hold harmless Living the Life B.V. and its officers, employees, contractors, suppliers and service providers from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or of any law, or your infringement of any third party's rights.

Section 17 - Returns address

Because our items are dispatched from different locations, the return address depends on the item. Please contact us at info@the72hourkit.com before returning anything and we will confirm the correct address. Return address: given by email when you contact us. Section 18 - Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law and the remaining provisions will continue in full force and effect.

Section 19 - Termination

These Terms are effective until terminated by you or by us. You may terminate them at any time by stopping use of the site. We may terminate them, and deny you access to the Service, without notice if we judge that you have breached them. Obligations and liabilities incurred before termination survive it, and you remain liable for all amounts due up to the date of termination.

Section 20 - Entire agreement

Our failure to exercise or enforce any right or provision of these Terms does not waive that right or provision. These Terms and the policies posted on the site constitute the entire agreement between you and us regarding the Service and supersede any prior agreements or communications. Any ambiguity in interpreting these Terms shall not be construed against the drafting party.

Section 21 - Governing law

These Terms and any contract for the sale of goods through the site are governed by the laws of England and Wales. As a consumer you may bring a claim in the courts of the part of the United Kingdom in which you live, and you benefit from any mandatory consumer protection provisions of that law.

If you have a complaint, please contact us first and we will do our best to resolve it. You can also contact your local Citizens Advice consumer service for free advice.

You can review the most current version of these Terms at any time on this page. We may update or replace any part of them by posting changes on the site. Changes do not affect orders already placed. Your continued use of the site after changes are posted means you accept them.
